Terms & Conditions

These Terms & Conditions (“Terms”) govern your use of the Morning Nutriz website at morningnutriz.com and the breakfast subscription service operated by Sejal Engitech Pvt Ltd (“we”, “our”, “us”). By placing an order or creating an account, you confirm that you have read, understood, and agree to these Terms. If you do not agree, please do not use our service.

1. About the Service

Morning Nutriz provides a fresh breakfast subscription service delivering rotating daily menus of fruits, vegetables, and protein-rich items to select areas in Bengaluru, Karnataka, India.

Service area: We currently deliver only to BTM Layout, HSR Layout, Begur, and Kudlu in Bengaluru. Orders placed with addresses outside these areas will not be accepted.

We reserve the right to modify, suspend, or discontinue any part of the service at any time with reasonable notice.

2. Eligibility

To use our service, you must:

  • Be at least 18 years of age
  • Have a valid Indian phone number and email address
  • Provide a delivery address within our service area
  • Provide accurate and complete information when placing an order

3. Orders and Subscription

Order placement: An order is confirmed once you have successfully submitted the order form and received an order confirmation. We will contact you via phone or WhatsApp to verify details before your subscription begins.

Subscription plans: We offer monthly (and other duration) plans with a rotating daily menu. The exact menu items may vary based on seasonal availability, quality, and operational requirements.

Plan availability: Certain plans may be marked as “Coming Soon” and are not yet available for ordering. We reserve the right to launch or withdraw plans at any time.

Menu variations: The 28-day rotating menu is indicative. Specific items may be substituted for items of equal or greater nutritional value without prior notice, due to availability or quality.

4. Delivery Policy

Delivery areas: Deliveries are made to BTM Layout, HSR Layout, Begur, and Kudlu only. We do not deliver to other areas of Bengaluru at this time.

Delivery timing: Deliveries are made in the morning. Exact delivery windows may vary by area and will be communicated at the time of confirmation.

Order cutoff times (IST):

Order placed before 5:00 PM
First delivery the next morning
Order placed after 5:15 PM
First delivery the morning after next

We are not responsible for delivery delays caused by incorrect addresses, inaccessible premises, natural events, or circumstances beyond our control.

Failed deliveries: If a delivery cannot be completed due to recipient unavailability or access issues, it will be treated as delivered and no refund will be issued for that day.

5. Pricing and Payment

Pricing: All prices are listed in Indian Rupees (INR) and are inclusive of applicable taxes unless stated otherwise. Prices are subject to change at any time; changes will not affect confirmed orders already paid.

Early bird pricing: Promotional or early bird prices are time-limited and may be withdrawn at any time without prior notice.

Payment timing: Payment is collected before your first delivery, not at the time of order placement. Our team will share payment details via WhatsApp or phone call after order confirmation.

Payment methods: Payments are processed via Cashfree Payments and include UPI, debit/credit cards, net banking, and wallets. By making a payment, you agree to Cashfree's terms of service.

Failed payments: If payment is not received within 48 hours of the confirmation call, we reserve the right to cancel the order without further notice.

6. Cancellation and Refund Policy

Before first delivery: You may cancel your subscription before payment is made, at no charge. Once payment is made, cancellation requests will be reviewed case by case.

After payment (before first delivery): A cancellation requested within 24 hours of payment and before the first delivery may be eligible for a full refund. Requests after this window are not eligible for refund.

After first delivery: No refunds are issued once deliveries have commenced, except in cases of repeated delivery failures on our part or verified food quality issues.

Subscription pauses: We do not currently support pausing a subscription. Please contact us on WhatsApp if you have special circumstances and we will try to accommodate.

Refund processing: Approved refunds will be processed to the original payment method within 5–7 business days.

7. Food Safety and Allergens

Our meals are prepared in kitchens that may handle common allergens including nuts, dairy, eggs, gluten, and seafood. We cannot guarantee an allergen-free environment.

It is your responsibility to inform us of any food allergies or dietary restrictions at the time of ordering. We will do our best to accommodate, but we do not guarantee that specific ingredients can always be excluded.

Morning Nutriz is not liable for any allergic reactions or adverse effects resulting from consumption of our products where allergen information was not disclosed by the customer.

8. Account Responsibility

You are responsible for maintaining the confidentiality of your account credentials. Any activity that occurs under your account is your responsibility. Notify us immediately at support@morningnutriz.com if you suspect unauthorised access.

We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or misuse the platform.

9. Intellectual Property

All content on morningnutriz.com, including text, images, logos, menus, and design, is owned by or licensed to Sejal Engitech Pvt Ltd. You may not reproduce, distribute, or use our content for commercial purposes without prior written consent.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Morning Nutriz and Sejal Engitech Pvt Ltd shall not be liable for:

  • Any indirect, incidental, or consequential damages arising from use of our service
  • Loss of data, revenue, or profits
  • Delays or failures caused by third-party service providers (Cashfree, Supabase, etc.)
  • Events beyond our reasonable control (force majeure), including natural disasters, civil unrest, government orders, or logistics disruptions

Our total liability in any matter arising from or related to the service is limited to the amount you paid for the subscription in the relevant period.

11. Governing Law and Disputes

These Terms are governed by the laws of India. Any disputes arising from or related to these Terms or our service shall be subject to the exclusive jurisdiction of the courts in Bengaluru, Karnataka, India.

Before initiating legal proceedings, we encourage you to contact us to resolve any dispute amicably. Most concerns can be resolved quickly via WhatsApp or email.

12. Changes to These Terms

We reserve the right to update these Terms at any time. We will notify users of material changes by updating the “Last updated” date. Continued use of the service after changes are posted constitutes your acceptance of the revised Terms.
